This Privacy policy is part of, and incorporated into, the Terms and Conditions. b. Provide and maintain the Service. For example Ubuntu Cab App relies on automated processes to enable essential parts of our services, including matching (pairing users requesting and providing transportation and/or delivery services), pricing (calculating the amount owed for such services) and fraud detection and prevention. These processes allow Ubuntu to provide a seamless, and safe, experience to its users every day
c. Facilitate communications between Riders and Drivers.
d. Offer customer support and diagnose technical and service problems.
e. Send communications and administrative emails about the Service and reply to your inquiries.
f. Provide you with promotional and advertising materials, which may be based on your prior activity.
g. Personalize and tailor the features, performance and support of the Website, App and Service.
h. Send you promotional/marketing information, newsletters, offers or other information from us or on behalf of our sponsors or partners.
i. Offer you participation in special events, programs, surveys and market research.
j. Provide you with opportunities and functionality that we think would be of particular interest to you.
k. Improve existing and develop new products and services.
l. Improve the quality and safety of the Website, App and Service and perform internal operations.
m. Analyze, benchmark and conduct research on Rider and Driver data and interaction with the Service.
n. Perform accounting, auditing and other corporate procedures.
o. For Safety, security and fraud prevention and detection.
p. Comply with and enforce applicable legal requirements, relevant industry standards and our policies or as required by regulators, government entities, and official inquiries under applicable laws, regulations, operating licenses or agreements, insurance policies.
q. The requisite access to location serves a dual purpose:
•To efficiently assign driver requests in close proximity to their current location
•to ensure accurate computation of trip distances, thereby preventing instances of underbilling

3. Third Party Sharing

We know how important it is to keep your information confidential. We will not rent, sell or share your Personal Information with third parties except as specifically approved by you at the time of disclosure or under the circumstances described below.
In addition to using the information collected by us for the purposes described above, we may also share your information with the following categories of recipients as described below:

a) Riders and Drivers
We share certain information about Riders (e.g., name, rating, pick-up and drop-off locations) with Drivers to enable the scheduling and provision of Rides.

b) Ubuntu Cab LLP partners
We may share all or some of your Personal Information with any of our subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. Additionally, in the event we undergo a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Privacy Policy, and that any entity that acquires us, is merged with us or that acquires our assets may continue to process your Personal Information as set forth in this Privacy Policy.

c) Service Providers
We also share Personal Information with vendors, consultants and data processors who perform services on behalf of Ubuntu Cab , including without limitation, companies that provide Payment services, email services and host the Website, App and Service. Ubuntu Cab has selected companies who maintain high standards with respect to privacy and agree to use the Personal Information only to perform specific services on behalf of Ubuntu Cab and in accordance with the terms and conditions of this Privacy Policy.

d) Law Enforcement, compliance and Safety
We may disclose information we have collected about you if required to do so by law or if we, in our sole discretion, believe that disclosure is reasonable to comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law), or to protect or defend Ubuntu or a third party’s, rights or property. We may also reserve the right to disclose information we’ve collected about you for purpose of protecting the health and safety of our Riders and Drivers, such as in the case of risk of harm or violence against any person.

e) Promotional, marketing and strategic partners
We may share limited data like your email address with our promotional, marketing and strategic partners so that they can inform you about promotional events and provide you with information and marketing messages about products or services that may interest you. In addition, we may share your personal data with marketing platform providers, including social media advertising services, advertising networks, third-party data providers, to reach or better understand our users and measure the effectiveness of our ads on other platforms and with social media platforms, including Facebook and Google, for sign-in purposes.

4. Data Security

We are very concerned with safeguarding your information. We employ all reasonable administrative, physical and electronic measures designed to protect your information from unauthorized access. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email, text or conspicuous posting on the Website in the most expedient time possible and without unreasonable delay, insofar as it is consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system. Although guaranteed security does not exist either on or off the Internet, we make commercially reasonable efforts to make the collection and security of such information consistent with this Privacy Policy and all applicable laws and regulations.

5. Data Retention and Deletion

a. Ubuntu Cab retains your data for as long as necessary for the purposes described above, which varies depending on data type, the category of user to whom the data relates, the purposes for which we collected the data, and whether the data must be retained after an account deletion request for the purposes described below.
For example, we retain data:
• For the life of your account if such data is necessary to provide our services (such as account data)
• For defined periods as set out below, including as necessary to meet tax, insurance, legal or regulatory requirements:
o Financial data regarding transportation services provided to passengers will be stored for 5 years after the last journey.
o Data required for accounting purposes will be stored for 7 years [after the last journey].
o In the event that there are suspicions of a criminal offence, fraud or false information having been provided, the data will be stored for 10 years.
o In case of payment disputes, data will be retained until the claim is satisfied or the expiry date of such claims.
o Journey history data will be stored for 5 years, after which the data will be anonymized.
o Please note that the deinstallation of the Ubuntu Cab App in your device does not cause the deletion of your personal data.
o If the Ubuntu App has not been used for six (6) months , we will notify you and ask you to confirm whether account is still active. If no reply is received, the account will be closed and personal data will be deleted unless such data is required to be stored for accounting, dispute resolution or fraud prevention purposes.
b. You may request that we delete your account through the Settings menus in the Ubuntu Cab app. Following an account deletion , we delete your account and data, except as necessary for purposes of safety, security, fraud prevention or compliance with legal requirements, or. We generally delete data within 60- 90 days of an account deletion except where retention is necessary for the abovementioned reasons.

6. User Rights

All Users of the Ubuntu Cab App have the following rights as it relates to all their data:

a. Right of Access: You have the right to access and to request copies of your personal data by contacting our Customer Support Team.
b. Right of Rectification: You have the right to request us to correct personal data that is inaccurate or incomplete. You can change and correct certain personal data yourself within the Ubuntu Cab App or by contacting our Customer Support Team.
c. Right of Erasure: You have the right to request that we erase your personal data, under certain conditions (e.g., we are processing your personal data under your consent). Personal data that is processed pursuant to a legal obligation or where we have an overriding legitimate interest may not be deleted upon request. You can request erasure of your personal data by contacting our Customer Support Team.
d. Right to Restrict Processing: You have the right to request that we restrict the processing of your personal data, under certain conditions (e.g., we are processing your personal data under consent). You can request restriction of the use of your personal data by contacting our Customer Support Team.
e. Right to Object: You have the right to object to our processing of your personal data, under certain conditions (e.g., we are processing your personal data under legitimate interests). You may submit an objection to the use of your personal data by contacting our Customer Support Team.
f. Right to object to automated decision making: - You have the right, under certain circumstances, to object to any solely automated decisions we have made which have a legal effect or similarly significant effect which does not involve human review. You can ask that a person review the decision, obtain an explanation of the decision reached after such assessment and challenge the decision by contacting our Customer Support Team. Please note that certain exceptions and limitations may apply to your right to object to automated decision-making, as permitted by applicable laws and regulations. Withdrawing your consent won’t change the legality of processing undertaken by Ubuntu Cab before you withdraw your consent.

Ubuntu Cab may provide links to other websites or content that may be of interest to you. However, we are not responsible for the privacy practices employed by those websites or content providers, nor are we responsible for the information they contain. -Data required for accounting purposes will be stored for 7 years [after the last journey].
-In the event that there are suspicions of a criminal offence, fraud or false information having been provided, the data will be stored for 10 years.
-In case of payment disputes, data will be retained until the claim is satisfied or the expiry date of such claims.
-Journey history data will be stored for 5 years, after which the data will be anonymized.
-Please note that the deinstallation of the Ubuntu Cab App in your device does not cause the deletion of your personal data.
-If the Ubuntu App has not been used for six (6) months , we will notify you and ask you to confirm whether account is still active. If no reply is received, the account will be closed and personal data will be deleted unless such data is required to be stored for accounting, dispute resolution or fraud prevention purposes.

You may request that we delete your account through the Settings menu in the Ubuntu Cab app. Following an account deletion request, we delete your account and data, except as necessary for purposes of safety, security, fraud prevention or compliance with legal requirements. We generally delete data within 60- 90 days of an account deletion request, except where retention is necessary for the above-mentioned reasons.

All Users of the Ubuntu Cab App have the following rights as it relates to all their data:
